LIMITED WARRANTY AND SALES TERMS
Limited Warranty - Manufacturing Defects Only
This product includes a limited warranty covering manufacturing defects only. This warranty applies solely to defects in materials or workmanship that were present at the time of manufacturing and that become apparent during initial installation or first use. Minor adjustments, alignment issues, installation corrections, routine setup matters, or field adjustments discovered during installation are not considered manufacturing defects and are not covered under this warranty. Because any true manufacturing defect is typically discovered during installation or initial setup, the Buyer must inspect the product immediately upon delivery and during installation. Any claim for a manufacturing defect must be reported within the warranty period. This warranty does not cover damage, defects, or performance issues caused by transportation, unloading, handling, installation practices, site conditions, environmental exposure, misuse, abuse, neglect, modification, alteration, or normal wear and tear. Professional installation is required. Installation must be performed by a qualified installer or contractor familiar with the proper setup of this type of equipment. Improper installation, self-installation, or installation not performed by a qualified professional will void this warranty.
Warranty Period
This limited warranty applies for 90 days from the date of delivery or pickup unless otherwise stated in writing by the Seller.
Parts-Only Warranty
This warranty applies only to the specific component determined to be defective and does not apply to the entire unit. The Seller's sole obligation under this warranty is to provide a replacement part for the defective component, at the Seller's discretion. Repair or replacement of parts does not extend or restart the warranty period.
Labor Not Included
This warranty covers replacement parts only. All labor, installation, removal, repair, service, or diagnostic costs are the responsibility of the Buyer.
Shipping Responsibility
Replacement parts may be supplied free of charge, however all shipping, freight, and handling costs are the responsibility of the Buyer. Replacement parts are typically shipped from the manufacturer or parts supplier and shipping charges apply regardless of the Buyer's location.
Cosmetic, Finish, and Environmental Exclusions
Cosmetic conditions and finish-related issues are not considered manufacturing defects and are not covered under this warranty. This includes paint chipping, paint fading, surface rust, oxidation, coating deterioration, discoloration caused by UV exposure, corrosion from rain, humidity, condensation, environmental exposure, or salt air environments. Surface scratches, scuffs, marks during handling or installation, and caulking or sealant discoloration, cracking, shrinking, or peeling are considered normal maintenance and are not covered under warranty.
Delivery Inspection and Acceptance
The Buyer is responsible for inspecting the product at the time of delivery or pickup. Any visible damage, missing components, cosmetic concerns, or shipping-related issues must be reported immediately upon delivery and before installation or use. Acceptance of the product at delivery, or failure to report issues within 24 hours of delivery, constitutes confirmation that the product was received in satisfactory condition.
Handling and Lifting Damage
The product must be lifted and transported using appropriate equipment and proper lifting procedures. Damage caused by forklifts, lifting equipment, chains, straps, rigging, trailers, or improper handling during unloading, transport, relocation, or installation is not considered a manufacturing defect and is not covered under this warranty. Lifting or supporting the unit from non-structural areas including the roof, door frame, railings, plumbing fixtures, interior components, trim, panels, or other non-designated lift points will void the warranty.
Owner Maintenance Responsibility
The Buyer is responsible for ongoing inspection, maintenance, and upkeep of the product after delivery and installation. This includes inspecting and tightening plumbing connections, water supply fittings, drains, valves, and seals; maintaining caulking and sealants; inspecting hinges, fasteners, and mounting hardware; and performing routine adjustments or preventative maintenance. Failure to perform normal maintenance may result in damage or performance issues that are not considered manufacturing defects and are not covered under warranty.
Shipping Damage and Freight Claims
Products shipped by third-party freight carriers travel under the carrier's responsibility and insurance coverage. Any damage occurring during transportation must be handled through the freight carrier's insurance claim process. Buyers must inspect shipments before signing delivery receipts and note any damage.
Payment and Retention of Title
Title to the product shall remain with the Seller until full payment has been received and cleared. If payment is made by check, ACH, or other non-cash method, ownership of the product does not transfer until funds have fully cleared the Seller's bank. Delivery or possession of the product by the Buyer does not constitute transfer of ownership until payment has been fully received and verified.
Recovery of Product in Event of Non-Payment
If payment for the product is not received in full, or if any payment is returned, reversed, or fails to clear, the Seller retains the right to reclaim possession of the product. The Buyer agrees that the Seller shall have the right to immediate possession of the product until full payment has been received. The Buyer agrees to cooperate in arranging prompt return or recovery of the product in the event of non-payment. Any costs associated with recovery, transportation, handling, or storage of the product resulting from non-payment shall be the responsibility of the Buyer.
Final Sale - No Returns or Refunds
All sales are final. Due to the size and handling requirements of this equipment, no returns, cancellations, or refunds are permitted after purchase or delivery.
Indemnification
The Buyer agrees to indemnify and hold the Seller harmless from any claims, damages, liabilities, or expenses arising from the installation, handling, or use of the product.
Governing Law and Venue
Any dispute arising from the sale or use of this product shall be governed by the laws of the State of Florida and handled exclusively in the courts located in Hillsborough County, Florida.
Severability
If any provision of this warranty is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Warranty Disclaimer
EXCEPT FOR THE LIMITED WARRANTY EXPRESSLY STATED IN THIS DOCUMENT, THE PRODUCT IS SOLD "AS-IS" AND WITHOUT ANY OTHER WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability
THE SELLER'S MAXIMUM LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE OF THE PRODUCT. UNDER NO CIRCUMSTANCES SHALL THE SELLER BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES INCLUDING LABOR COSTS, LOSS OF USE, BUSINESS INTERRUPTION, OR PROPERTY DAMAGE.
